Welcome to Berlin Photo Studio (“we”, “us”, “our”).

Berlin Photo Studio operates this website and store, including all related services such as:
• Film development (C41, Black & White, ECN-2, E6, Scala)
• Film scanning
• Printing services
• Sale of film, cameras and accessories
• Workshops and events
• Gift cards and digital services

Our online store is powered by Shopify. However, all purchases and contracts are made directly with Berlin Photo Studio.

By accessing or using our website or services, you agree to be bound by these Terms & Conditions and our Privacy Policy.

If you do not agree, please do not use our services.

2. Legal Contract & Acceptance of Orders

When placing an order, you submit a binding offer to purchase.

A contract is formed only once we confirm your order via email or begin processing your order.

We reserve the right to refuse or cancel orders at our discretion, especially in cases of:
• Incorrect pricing
• Product unavailability
• Suspicion of fraud
• Technical errors

3. Products & Services

3.1 Product Representation

We make every effort to accurately display products. However:
• Colors may vary due to screen settings
• Vintage or used products may show normal signs of wear
• Film results vary depending on exposure, storage, camera and processing conditions

We do not guarantee artistic outcomes.

Film photography involves natural unpredictability.

4. Film Development & Scanning Services

4.1 Risk & Liability

Film is a unique and irreplaceable medium.

While we handle all materials with care, by submitting film for processing, you acknowledge:
• Processing is done at your own risk
• Film may have been previously damaged due to storage, X-ray exposure, age, or incorrect shooting
• We are not responsible for pre-existing damage

In case of lab error caused directly by us, liability is limited to:
• Replacement of an unused film roll of equivalent type
OR
• Refund of the development service cost

We are not liable for:
• Lost artistic value
• Emotional value
• Indirect or consequential damages

4.2 Negative Storage Policy

We store developed negatives for approximately two months.

Negatives not collected by the end of the following month may be disposed of without further notice.

We are not a long-term archive or storage facility.

Customers are responsible for collecting their negatives in time.

4.3 Scanning & Digital Files

Digital scans are delivered:
• Via download link
• In the selected format (JPEG or TIFF)
• At the resolution specified at the time of purchase

We are not responsible for:
• File storage after delivery
• Data loss on your personal devices

Please download and back up your files immediately.

5. Workshops & Events

Workshop tickets are binding upon purchase.

Refunds or cancellations are governed by our Refund Policy.

If we must cancel an event due to unforeseen circumstances, you will receive:
• A full refund
OR
• The option to rebook

Participants are responsible for their own safety during workshops and events.

6. Pricing & Payment

All prices are listed in Euro (€).

Prices may include or exclude VAT depending on your business status (Kleinunternehmer or VAT registered – adjust accordingly).

Shipping costs are displayed separately at checkout.

We reserve the right to change prices at any time without prior notice.

7. Shipping & Risk Transfer

For physical goods:
• Risk transfers to the customer once the package is handed to the shipping carrier.
• Delivery times are estimates only.

We are not liable for:
• Shipping delays
• Customs delays
• Lost packages caused by the carrier

8. Used & Vintage Equipment

Used cameras, lenses, and accessories are sold with condition descriptions.

Unless otherwise stated:
• Items are sold as used goods
• Minor cosmetic wear is normal
• Functionality is tested when specified

If an item is sold as “untested”, it is sold without guarantee of functionality.

9. Gift Cards

Gift cards:
• Cannot be redeemed for cash
• Are non-refundable
• May have expiration dates as specified

Lost or stolen gift cards cannot be replaced.

10. Right of Withdrawal (EU Consumers)

Consumers within the European Union have a statutory 14-day right of withdrawal for physical goods.

Exceptions apply to:
• Custom-made products
• Opened film rolls
• Digital products after download
• Development and scanning services once processing has begun
• Event tickets with fixed dates
