Berlin Photo Studio — Refund, Return and Withdrawal Policy

This policy separates your statutory rights from our additional voluntary return policy. Nothing in this policy limits mandatory consumer rights, statutory warranty rights, or remedies for defective or incorrectly supplied goods.
1. Statutory rights for defective or incorrect goods
If an item is defective, damaged in transit, not as described, or you receive the wrong item, contact us at info@photostudioberlin.com and provide your order number, a description of the issue, and, where reasonably possible, photographs of the item and packaging.
Your statutory rights are not subject to the voluntary return conditions below. Where a return is required because goods are defective or incorrectly supplied, Berlin Photo Studio will bear the necessary return costs.
2. Statutory 14-day right of withdrawal for consumers
If you are a consumer and conclude an eligible distance contract with us, you generally have the right to withdraw from the contract without giving a reason.
For goods, the withdrawal period is 14 days from the day on which you, or a third party nominated by you other than the carrier, receives the goods. For an order containing several goods delivered separately, the period begins when the last item is received. For services and eligible digital content, the period generally begins when the contract is concluded.
You may also send an unequivocal withdrawal declaration before dispatch or delivery where the statutory right applies.
How to withdraw
To exercise the statutory right of withdrawal, inform us by using any statutory withdrawal function provided on our website or by sending an unequivocal statement to:

You may use the model withdrawal form at the end of this policy, but it is not mandatory. Sending the declaration before the deadline is sufficient. A statutory withdrawal does not require our prior approval.
Returning goods after withdrawal
You must return the goods without undue delay and no later than 14 days after informing us of the withdrawal. The deadline is met if you dispatch the goods before the 14-day period expires.
Unless we supplied defective or incorrect goods, you bear the direct cost of returning the goods. Please use suitable protective packaging and, for valuable cameras and lenses, a tracked and insured service. Refusing delivery or failing to collect a parcel does not by itself replace an unequivocal withdrawal declaration.
Refund after statutory withdrawal
We will reimburse payments received from you, including the cost of our least expensive standard delivery option, without undue delay and no later than 14 days after receiving your withdrawal declaration. Additional costs resulting from choosing a more expensive delivery method are not reimbursed.
For goods, we may withhold reimbursement until we receive the returned goods or you provide evidence that you sent them back, whichever occurs first. Reimbursement will be made using the original payment method unless expressly agreed otherwise, and no reimbursement fee will be charged.
You are responsible only for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
3. Exceptions and early expiry of the statutory withdrawal right
The statutory right of withdrawal does not apply, or may expire early, only where the legal requirements are met. Relevant examples may include:
- goods made to the consumer’s specifications or clearly personalised;
- workshops, events, photowalks, studio bookings, or other leisure services scheduled for a specific date or period;
- services that have been fully performed after the consumer expressly requested performance during the withdrawal period and acknowledged that the right of withdrawal would expire upon complete performance;
- digital content not supplied on a physical medium where performance has begun after the consumer expressly consented to immediate performance, acknowledged the resulting loss of the withdrawal right, and received the legally required confirmation.
Sourcing a standard camera, lens, or other standard product specifically for an order does not by itself make that product personalised.
Film development, scanning, printing, and other services
Film processing and related lab work are time-sensitive and may become irreversible once work begins. If you expressly request that we begin a service during the statutory withdrawal period, we may start work before that period ends. If you withdraw after performance has begun but before it is complete, you may be required to pay a proportionate amount for the work already performed where the legal conditions are met. The withdrawal right for a service expires only after complete performance and only where the legally required request, consent, acknowledgement, and information have been provided.
Sending film to the lab or placing an order does not, by itself, waive a statutory withdrawal right.
4. Additional voluntary 30-day return policy
In addition to statutory rights, we offer consumers a voluntary return option for eligible new physical goods. A request must be made within 30 days after delivery, and the product must be dispatched within 14 days after we provide the return instructions.
To qualify under this voluntary policy, the item must be unused, complete, in the condition received, and returned with its original packaging, accessories, seals, tags, and proof of purchase. A reasonable inspection comparable to an in-store inspection is permitted; use beyond that may make the item ineligible for the voluntary return.
Contact info@photostudioberlin.com before sending a voluntary return so that we can identify it and provide instructions. Goods returned without sufficient order information may be delayed or returned to the sender.
Items excluded from the voluntary 30-day return policy
- pre-orders and “Sourced for You” products;
- used, vintage, unique, or one-off cameras, lenses, and accessories;
- opened, loaded, exposed, refrigerated, or temperature-sensitive film;
- opened photographic paper, chemistry, hazardous materials, and consumables;
- custom-made, modified, engraved, or personalised products;
- gift cards and vouchers;
- digital products and delivered downloads;
- film development, scanning, printing, studio rental, and other services;
- workshops, events, photowalks, and other date-specific bookings;
- clearance or final-sale items explicitly identified as such before purchase.
These exclusions apply only to our additional voluntary policy. They do not remove any statutory withdrawal, warranty, conformity, or defect rights that apply in an individual case.
For an accepted voluntary return, the customer bears the return cost. Original outbound delivery charges and premium delivery surcharges are not refunded under the voluntary policy. This does not affect the different refund rules that apply to a valid statutory withdrawal or defective goods.
5. Pre-orders and “Sourced for You” products
Products marked “Pre-Order” or “Sourced for You” are not available for immediate dispatch. After order confirmation, Berlin Photo Studio may begin sourcing, purchasing, inspecting, and preparing the selected product. Unless a product page states otherwise, payment is collected at checkout.
The usual sourcing and preparation estimate is 3–4 working weeks unless a different timeframe is displayed on the product page. Delivery dates are estimates unless expressly agreed as binding. If sourcing is delayed, we will provide an updated estimate. If we cannot source a suitable product, we will cancel the affected item and issue a full refund for it.
For sourced used or vintage equipment, photographs may be illustrative unless the product page explicitly states that the exact photographed unit will be supplied. The delivered item will correspond to the ordered model and stated condition grade, but normal cosmetic differences may occur.
Pre-orders and “Sourced for You” products are excluded from our additional voluntary 30-day return policy because we commit procurement resources specifically for the order. This does not restrict a consumer’s statutory rights. In particular, sourcing a standard product does not remove the statutory right of withdrawal where it applies.
For verified business customers acting exclusively in the course of their commercial or professional activity, no statutory consumer withdrawal right applies. B2B cancellations, including pre-orders, require our written agreement and may be subject to reasonable documented costs where agreed.
6. Used and vintage equipment
Used and vintage cameras, lenses, and accessories may show age-related wear, cosmetic marks, or other characteristics described on the product page. A disclosed characteristic or ordinary wear consistent with the stated condition is not automatically a defect.
Labels such as “used” or “untested” do not exclude mandatory statutory rights. Where an item is offered as untested, the description explains the scope of testing performed and the known condition; it is not a waiver of rights that cannot legally be waived.
Used and vintage equipment is excluded from the additional voluntary 30-day return policy, but applicable statutory withdrawal and conformity rights remain unaffected.
7. Workshops, events, bookings, digital products, and gift cards
Bookings for workshops, events, photowalks, studio rentals, or other leisure services tied to a specific date or period are generally excluded from the statutory withdrawal right. Unless the product page provides a different cancellation rule, tickets are non-refundable if the event takes place as scheduled. You may ask us whether a booking can be transferred to another person or moved to another available date, but this is not guaranteed.
If Berlin Photo Studio cancels a workshop or event, you may choose a full refund or, where offered, rebooking.
Digital products and gift cards are excluded from the voluntary 30-day return policy. Any applicable statutory rights remain unaffected. A digital-content withdrawal right expires early only when the legal consent, acknowledgement, commencement, and confirmation requirements have been met.
8. Return inspection and refund processing
Please include your name and order number with the return. After receipt, we will inspect the item and notify you of the outcome.
Refunds under the voluntary policy are issued to the original payment method, normally within 10 business days after approval. Your payment provider may require additional processing time. Statutory refund deadlines remain unaffected.
We may refuse a voluntary return or make an appropriate deduction where an item is incomplete, used beyond inspection, damaged after delivery, missing accessories, or otherwise fails the voluntary conditions. Any deduction under statutory withdrawal rules is limited to what applicable law permits.
9. Exchanges
We do not offer automatic direct exchanges. For eligible goods, the fastest option is usually to complete a return and place a separate order. We may offer a replacement directly where goods are defective or incorrectly supplied.
